First direct container MV Harbour-1Vessel between India and

Bangladesh flagged off from Krishna patnam

29-MAR-2016

The first direct container MV Harbour-1 Vessel between India and Bangladesh carrying cotton was flagged off from Krishnapatnam of Andhra Pradesh to Chittagong on 28 March 2016.

The voyage was started as a part of a coastal shipping agreement to facilitate trade between India and Bangladesh.

The trade agreements were earlier signed during the reign of the then Indian Prime Minister Indira Gandhi in 1974 and they were revived back after a period of four decades during Prime Minister Narendra Modi's visit to Dhaka in June 2015.

Key Features of the Agreement

A standard operating procedure was signed between India and Bangladesh in November 2015 to move commercial cargo between the two countries. The provisions and procedures to be followed for such movement were also stated.

Many conditions were waived by both countries to facilitate easy bilateral trade. The vessels of both the countries upon entry in to India and Bangladesh shall be treated as domestic vessels and not foreign going vessels.

The provision will play a key role in addressing the traffic congestion at Petrapole (India) and Benapole (Bangladesh) the two border points which pose as one of the biggest impediments to the movement of EXIM cargo.

This will also offer to reduce the paper work required at the customs check points and port dues paid at Indian ports too will be at par with Indian vessels.

The vessel and cargo will also enjoy complete Protection and Indemnity (P&I) coverage insuring cargo from the point of loading to the final destination and till the time the parcel reaches the final consignee.

Both the countries agree to reduce customs documentation and other requirements to the essential minimum for the purpose of easier cargo movement and to have custom stations at or near the points of entry and exit in each country.

Trade between two countries

Earlier the shipments from Indian ports being transported to Bangladesh were routed either via Colombo or Singapore. With the launch of the direct service, time taken for such shipments would come down from 2-5 days.

The opening of the sea route will also enable the movement of cargo to the North Eastern states of India through coastal shipping up to Chittagong and thereafter by road or inland waterways. Secondly, the deep draft ports on the eastern coast of India can be hub ports for the onward transportation of cargo to Bangladesh through River Sea Vessels (RSV).

Exports and Imports

Cargo moving from India to Dhaka on road will take up to 30 days. The present voyage will be reduce the travel time and become an advantage.

India mainly exports raw cotton, cotton, steel, tyres and minerals, among others, which are valued at 6 billion dollars per annum to Bangladesh.

It imports goods like textile yarn, fish, mineral fuels, cement, bran and husk which worth half a billion US dollars.

Telecom Commission approved 112 as
Single Emergency Number for India

29-MAR-2016

The Telecom Commission approved the number 112 as the single emergency number for India on 28 March 2016.   This is similar to 911of United States and 999 of United Kingdom.

With this, Indian citizens in distress can just dial the single-number 112 for all emergency services such as police, ambulance and the fire department. It will direct the call to concerned departments immediately for help.

The service will also be accessible even through those SIMs and landlines whose outgoing call facility has been stopped or temporarily suspended.

A user will be able to make communication even through SMS and the system will learn about the location of the caller that will be shared with the nearest help centre.

The service will be operated by a call centre like facility, which will have representatives speaking in Hindi, English and the local language.

All existing emergency numbers such as police (100), fire brigade (101), ambulance (102) and Emergency Disaster Management (108) will be phased out within a year of rolling out 112, depending upon the awareness about this new facility.

At present, different states of India have notified various helpline numbers for assistance to special categories of citizens. For example, Delhi notified 181 for Woman in distress, 1094 for Missing Children and Women, 1096 for Crime against Women, and Uttar Pradesh notified 1090 for Police Headquarter helpline.

Reasons to Adopt

It was chosen due to a variety of reasons. 100, which is one of the widely known numbers for emergency, was not recommended as it is associated with police and several sections of society, especially women and children, may not wish to dial it.

Telecom regulator TRAI suggested the adoption of 112 as the national emergency number in its recommendations submitted to the telecom department in April 2015.

Bangladesh Supreme Court upheld Islam as State religion

29-MAR-2016

The Supreme Court of Bangladesh on 28 March 2016 upheld the status of Islam as the State religion. The ruling was given by the High Court Division of the court while dismissing a petition filed by Samendra Nath Goswami.

Goswami challenged the legality of the constitutional provision of Islam as the state religion (8th Constitutional Amendment, 1988) despite revival of secularism as a fundamental state policy under a 2011 amendment to the Constitution.

Background

• Bangladesh was formed out of Pakistan as a Muslim majority country in 1971. As per the 2011 census, around 87 percent are Muslims and 12 percent are Hindus.

• The original 1972 constitution of Bangladesh explicitly specified secularism as one of the four fundamental principles that govern the polity of the nation.

• However, the secularism principle was removed from the constitution in 1977 by the 5th amendment by Ziaur Rahman-led Government.

• Subsequently, Islam was declared as the state religion by the 8th amendment to the constitution in 1988.

• In 2010, the Supreme Court restored secularism as one of the basic tenets of the constitution and declared the 5th amendment as illegal. However, the provision relating to Islam as the State religion remains untouched.

• In 2011, Sheikh Hasina-led Government, through the 15th constitutional amendment, restored the Article 12 of the constitution that declares secularism as a governing principle.

Comment

Politics in Bangladesh has long been split over the question of religion. The Khaleda Zia-led Bangladesh Nationalist Party (BNP), now in opposition, supporta the provision of Islam as the official religion.

The BNP argues that the status of Islam as the state religion reflectes the heritage of the vast majority of the population.

On the other side, the incumbent Prime Minister Sheikh Hasina-led Awami League is in favour of secularism and brought in the Article 12 of the constitution.

The Department of Industrial Policy and Promotion (DIPP) on 29 March 2016 notified Guidelines for 100 percent Foreign Direct Investment (FDI) in Business to Business (B2B) e-commerce.

The guidelines were issued under the Consolidated FDI Policy Circular 2015 that was notified by the DIPP of the Ministry of Commerce and Industry.

• 100 percent FDI under automatic route is permitted in marketplace model of e-commerce.

• FDI is not permitted in inventory based model of e-commerce.

• Marketplace e-commerce entity will be permitted to enter into transactions with sellers registered on its platform on B2B basis.

• E-commerce entity providing marketplace will not exercise ownership over the inventory. Such an ownership over the inventory will render the business into inventory based model.

Marketplace model vs. Inventory

model

• Marketplace based model of e-commerce means providing of an information technology platform by an e-commerce entity on a digital and electronic network to act a facilitator between buyer and seller.

• Inventory based model of e-commerce means e-commerce activity where inventory of goods and services is owned by e-commerce entity and is sold to the consumers directly.

• In marketplace model, any warrantee or guarantee of goods and services sold will be responsible of the seller.

Comment

As per the Consolidated FDI Policy Circular 2015, FDI up to 100 percent under automatic route is permitted in B2B e-commerce, while no FDI is permitted in Business to Consumer (B2C) e-commerce.

Though this consolidated policy was issued in May 2015 and led to large scale foreign investments in this sector there had been considerable vacuum with respect to operational guidelines of e-commerce platforms. This present guidelines fill that critical gap.

• E-commerce means buying and selling of goods and services including digital products over digital and electronic network.

• 100 percent FDI under automatic route is permitted in marketplace model of e-commerce.

• FDI is not permitted in inventory based model of e-commerce.

• Marketplace e-commerce entity will be permitted to enter into transactions with sellers registered on its platform on B2B basis.

• E-commerce marketplaces may provide support services to sellers in respect of warehousing, logistics, order fulfillment, call centre, payment collection and other services.

• E-commerce entity providing marketplace will not exercise ownership over the inventory. Such an ownership over the inventory will render the business into inventory based model.

• An e-commerce entity will not permit more than 25 percent of the sales affected through its marketplace from one vendor to their group companies.

• Indian Scenario: In India, 100 percent FDI under automatic route is permitted in marketplace model, while no FDI is permitted in inventory based model of e-commerce.

• In marketplace model, any warrantee or guarantee of goods and services sold will be responsible of the seller.

• E-commerce entities providing marketplace will not directly or indirectly influence the sale price of goods or services and shall remain level playing field.

Supreme Court approved guidelines of Union Government to protect Good Samaritans

30-MAR-2016

The Supreme Court on 30 March 2016 approved the guidelines of Union Government to protect Good Samaritans, who help road accident victims, from being unnecessarily harassed by police or any other authority.

The apex court asked Union government to give wide publicity to these guidelines so that people who help others in the time of distress are not victimised by any authority.

Union Ministry of Road Transport and Highways placed the guidelines based on the recommendations of the three-member committee chaired by former judge KS Radhakrishnan.

It placed the report before the apex court with an aim to issue these guidelines through an order binding on all states and Union Territories, until the Union government enacts a law to this effect because it is difficult to enforce these guidelines in the absence of any statutory backing.

Earlier in March 2016, the Apex Court had said it will pass an order on the recommendations of a committee headed by its former judge on road safety which advocated that people saving lives of road accident victims need not fear harassment by police or other authorities.

The court had in 2014 appointed the three-member committee to monitor steps taken by the Union and state governments to ensure road safety.

The committee gave 12 major recommendations including setting up of State Road Safety Councils, evolving a protocol for identification of black spots, their removal and monitoring to see the effectiveness of the action taken.

The committee had also suggested strengthening of enforcement relating to drunken driving, over-speeding, red light jumping and helmet or seat belt laws.
